TERMS AND CONDITIONS
Account Holder agrees to allow Borders to use the information provided herein to conduct a credit check and further agrees to be bound by Borders's terms of credit. Account Holder hereby gives permission to use any tools necessary to determine creditworthiness. If approved, an account card will be issued. Account Holder acknowledges that each use of the card(s) to make a purchase constitutes a credit sale for business purposes by Borders to Account Holder. Account Holder agrees that the account will be used strictly for business, commercial, agricultural, or governmental purposes, not for personal, family, or household purposes. Account Holder agrees to pay for all purchases made with the account. The invoice/receipt presented at the point of sale constitutes the official bill of sale. Payment is due 30 days from the date of the invoice/receipt. Each month, Borders will send Account Holder a statement of purchases made since the previous statement. Account with unpaid amounts over 30 days from the invoice shall be considered delinquent; Borders reserves the right to assess a late fee of $50.00 per month. Accounts with unpaid amounts over 90 days from the invoice date shall be subject, at Borders's sole discretion, to a credit hold or be closed. In the event that payment is not made in a timely manner, Account Holder agrees to pay all reasonable attorney's fees and court or other collection costs as permitted by law. Borders reserves the right to assess a fee for returned checks to cover administrative costs and bank charges. If Account Holder is entitled to a refund for any reason for goods or services charged to the account, Account Holder agrees to accept credits to the account instead of cash. Account Holder agrees to pay fees for special account services it requests, such as duplicate account statements, in such amounts as Borders may determine from time to time.
Account Holder assumes complete responsibility for protecting the security of each card issued and further agrees to immediately notify Borders of lost or stolen cards. You may be liable for unauthorized use of card(s), except if such use occurs after Borders has been notified by telephone or in writing at the Borders number or address included in this application. Account Holder agrees that any employee who presents a card or makes a purchase on Account Holder's account at the point of sale shall have implicit authority to do so, and Account Holder will be liable for all charges thereto. Account Holder may cancel the account upon 30 days' written notice to Borders at the address on this application. Account Holder shall be responsible for any outstanding balances and any new charges incurred up to and including the effective date of cancellation. Account Holder's signed application signifies agreement to these Terms and Conditions. Borders may amend or cancel this agreement at any time. Each amendment will become effective 15 days after Borders sends notice thereof to Account Holder and will apply all balances in the account, including amounts arising from transactions occurring prior to the effectiveness of the amendment. Borders may at any time change or cancel any credit line. The internal laws of the State of Michigan shall govern this agreement. Qualifying purchases exclude personal merchandise, certain "NET" books, electronics, video games, previous and online purchases, gift cards, periodicals, special orders not in stock, and shipping. May not be combined with other coupons, discounts, or in-store promotions. Discount applies to the retail price only, and may be used for business-related purchases only. Borders does not guarantee price or quantity on special orders.
